The review of the Yates, Brake Dust, Ford, Asbestos & Mesothelioma case documents what many brake and clutch repair auto mechanics may face today – past potential asbestos exposure and mesothelioma.

The court ruled:  These motions are granted in part and denied in part.

A brief summary of the facts include:

  •  Plaintiffs bring claims for personal injury and loss of consortium related to allegations that plaintiff Graham Yates contracted mesothelioma from defendants’ brake products (ford and honeywell).
  • Remaining for trial, scheduled to commence July 14, 2014, are plaintiffs’ claims for negligence in putting asbestos or asbestos-containing products into the market (First Cause) and failure to warn (Fifth Cause).
  • The court reviewed expert reports and considered the each and every exposure theory as it relates to asbestos exposure and mesothelioma
