The Serigny, Chevron, Seaman, Benzene & Leukemia case documents what many people may face today that may have worked in or around the petroleum industry, chemical industry and the petrochemical industry (on oil rigs, oil platforms, boats, ships and vessels) and been exposed to Benzene – leukemia or air borne chemical exposure.  The court ruled on the motion.

A brief summary of the facts include:

  • Plaintiff alleges that defendants, collectively, exposed him to benzene and benzene containing products while he was employed as a seaman aboard various vessels thirty-plus years ago, between 1962 and 1976.
  • As a result, he developed multiple myeloma. Plaintiff seeks recovery via the Jones Act, 46 U.S.C. § 30104, and general maritime law pursuant to the “saving to suitors” clause of 28 U.S.C. § 1333.
  • He did not demand a jury trial.
