Teacher Has Mesothelioma From Second Hand Asbestos Exposure

Ohio english teacher develops mesothelioma from second hand asbestos exposure and wins $27.5 million verdict (including a loss of consortium claim for his wife) in Cuyahoga County Common Pleas Court in Ohio.   The case revolves around the following facts:

• The second hand asbestos exposure that came from clothing worn by his father
• Apparently, his father picked up the asbestos dust from National Friction Products Corp. asbestos brake pads
• While working at Eaton Airflex brake company
• The father died of mesothelioma lung cancer at 52 after working at Eaton Airflex brake company for 31 years
• The main defendant was Kelsey-Hayes Co., the Michigan-based successor to National Friction Products

The liability was split between Eaton and Kelsey-Hayes Co.  Eaton was found to be immune under Ohio law.

People who develop this rare form of cancer were most likely exposed to dangerous asbestos fibers while working in various industries to support their families.   It is also becoming more common for the family members to develop mesothelioma from second hand asbestos exposure.  It is common for the development of mesothelioma to occur 20 or sometimes even 40 years after initial exposure to asbestos.  Asbestos fibers have been used in the manufacturing of a wide variety of industrial and household products in the United States and around the world.
