Stallings, Georgia Pacific, Asbestos & Mesothelioma: A case in the United States District Court, W.D. Kentucky, Louisville Division ruled on a motion for summary judgment.
The Stallings, Georgia Pacific, Asbestos & Mesothelioma case documents what many in the Navy working as a boiler operator may face today after past potential asbestos exposure – mesothelioma.
A brief summary of the facts include:
- William Stallings sued Georgia-Pacific Corporation, IMO Industries, Crane Company, John Crane Inc., and CBS Corporation under strict liability and negligence theories, alleging that exposure to their asbestos-containing products caused him to develop mesothelioma.
- William Stallings joined the Navy in 1955.After basic training, he was assigned to the USS Waller—first commissioned as a destroyer in 1942—as a boiler operator.In this job, he took readings on machinery, checked the oil, ran the fireboxes, and repaired boilers and pipes.Each fire room on the USS Waller had its own boilers, turbines, and pumps.
- In his deposition, Stallings testified that asbestos insulation covered all the steam and water lines, the turbines, and the boilers. Every time Stallings replaced a valve, he had to remove an asbestos gasket that went between the flanges of the valve.Consequently, he inhaled large quantities of asbestos dust while working for the Navy.
- Stallings served on the USS Waller from 1955 to 1959.Based on Captain Lowell’s experience, training, and review of Stallings’s deposition, Captain Lowell opined that Stallings “regularly came into contact with Asbestos containing materials associated with multiple pieces of equipment provided by and/or manufactured by John Crane, Crane Co., Westinghouse, and DeLaval (IMO) or companies now associated with them in his daily work over his approximately 3 ½ years on the USS Waller.”
- After leaving the Navy, Stallings worked as a drywall finisher for Timmerman Drywall and Stigler Drywall. For at least two years, he finished walls using the joint compound Bestwall, a Georgia-Pacific product.In September 2011, Stallings was diagnosed with mesothelioma, an incurable asbestos-related cancer.
- The court ruled: Granted.
