The Aubin, Union Carbide, Asbestos & Mesothelioma case documents what many construction workers (sanding, using drywall joint compounds etc.) may face today – past potential asbestos exposure and mesothelioma.
A brief summary of the facts include:
- William P. Aubin worked as a construction supervisor from 1972-1974 in Florida
- Aubin was exposed to and inhaled respirable dust created by the sanding and sweeping of drywall joint compounds and spraying of ceiling texture sprays.
- Claimed was caused by his exposure to SG-210 Calidria, an asbestos product designed and manufactured by Union Carbide Corporation
- Aubin did not know that these joint compounds and texture sprays contained asbestos and thus did not know that he was inhaling asbestos fibers.
- In 2008, Aubin was diagnosed with malignant peritoneal mesothelioma, which is a fatal, incurable form of cancer in the lining of the abdomen
The court ruled: These motions are granted in part and denied in part. To find out more on the case, see Case No. CS12-2075 – October 29, 2015.
