Union Carbide Ruling In An Asbestos Case


Union Carbide Corp. can file a motion asking the Mississippi Supreme Court to review an unfavorable Union Carbide ruling in an asbestos lawsuit case:

  • Mississippi Supreme Court threw out ruling in $3.85 million asbestos lung cancer judgment – judge’s flawedasbestos, mesothelioma, asbestos lawyer, asbestos law firm, asbestos attorney, mesothelioma lawyer, mesothelioma attorney, mesothelioma law firm
  • Asbestos lawsuit revolved around supposed exposure to drilling additives that contain asbestos made by union Carbide
  • Trial judge said plaintiff failed to show was exposed to a specific product on a regular basis in proximity to his work
  • Plaintiff – a smoker – was supposedly exposed to asbestos while working on petroleum drilling rigs from 1960s – 1990s
  • Supposedly chemical drilling additives containing asbestos were used regularly
  • Main argument revolves around “frequency, regularity, and proximity of exposure” test which is used by other states
  • This test is used to establishing proximate causation in products liability actions involving asbestos-related injuries and will affect other Mississippi asbestos cases
